Privacy policy

Version 9.0. Effective Date: September 10, 2026.

1. Introduction and Scope

Neon LLC ("Neon," "we," "our," or "us") is a Virginia limited liability company based in Prince William County, Virginia. Neon designs and sells the Neon Pace Clock and related accessories, including the Power Station for Neon Pace Clock, publishes the free Neon Swim app, resells and integrates third-party live streaming software and hardware for swim meet broadcasts and sells related consultation, and performs contract engineering for other companies (together, the "Services"). This Policy describes how Neon collects, uses, shares, and protects personal information through the Services, including our website, online store, app, and customer communications. Where this Policy and another Neon document address the handling of your personal information differently, this Policy controls on that subject.

Some of what we offer is not ours: live streaming for meets runs on software Neon resells and integrates but did not write. When you use that software directly, its own privacy notice governs your information there. This Policy governs only what Neon itself collects and does, including while reselling, integrating, or supporting that software. Our website and store also link to sites Neon does not operate. Neon does not control those sites, and this Policy does not govern what they collect.

2. Information We Collect

Website, online store, and customer relationship tools

Our website and online store are supported by outside service providers that handle website hosting, e-commerce and payment processing, and the tools that run our forms, appointment booking, and email and text communications. When you browse our website, place an order, book a consultation, submit a form, or otherwise contact us, we and these providers may receive information you give us, such as your name, email address, phone number, shipping and billing address, order history, and message content. Our payment processor handles your card information when you make a purchase; Neon does not receive or store your full card number.

Neon Swim app

The Neon Swim app does not require you to create an account. We may receive usage, performance, and diagnostic information that Apple or Google make available about how the app runs, depending on your device settings, and we use it to understand app reliability and troubleshoot problems, not to identify you. Neon Swim also offers optional in-app purchases and subscriptions through the Apple App Store and Google Play Store; Apple and Google handle all billing and payment information for these, and Neon does not receive or store your card number or billing details for anything bought through the app.

Trade-In Program

If you request a trade-in when you purchase a Neon Pace Clock, we collect what you enter about your old device (brand, model, whether it works, and whether it includes its original parts and documentation) and a record that you agreed to the Trade-In Program Terms and Conditions. This is stored with your order record and used to prepare your individualized trade-in estimate, evaluate the device Neon later receives, and process any refund. See our Trade-In Program Terms and Conditions for how the program itself works.

Contact with us

If you contact us by email, phone, text, or website form, including about live streaming integration, consultation, or contract engineering work, we keep what you give us, such as your name, organization, contact details, and the details of your request, so we can respond, scope the work, provide support, fulfill your order, and manage your booking or account.

3. Cookies and Similar Technologies

Our online store and the tools embedded on our website use cookies. Our e-commerce and booking platforms may set cookies to run checkout, forms, and scheduling, and to secure and improve their own systems. We also use a first-party cookie, "neon_cart," across our neoninnovation.com domain to keep your cart count consistent as you move between our website and our store, not to track you across other companies' websites. The advertising and personalization features of our online store platform, described in Section 5, also use cookies and similar technologies; Section 9 tells you how to opt out of those features.

Some pages on our website embed video from YouTube. We use YouTube's privacy-enhanced embed domain, which YouTube describes as not storing cookies about your viewing unless you play a video. If you play a video, or follow a link to a site we do not run, that service may set its own cookies under its own privacy notice, and Neon does not control what it collects.

You can control cookies through your browser settings, though blocking or deleting them may break some store or website features, including your cart.

4. How We Use Information

We use the information we collect to:

  • Operate, secure, and improve the Services;
  • Process and fulfill orders, including the Trade-In Program;
  • Provide customer support and respond to your questions;
  • Manage your bookings, accounts, and consultations, and communicate with you about them;
  • Understand how our website and store are used, through internal analytics;
  • Keep the business records we need for accounting, tax, warranty, and legal purposes; and
  • Send marketing communications about Neon's products and services, where you have not opted out.

Marketing email we send is intended to include an unsubscribe link. If you do not see one, or it does not work, email support@neoninnovation.com and we will remove you; either route reaches us, and we honor both. After you unsubscribe, we will still send messages tied directly to a transaction, order, or support request, such as shipping confirmations or answers to your questions.

We send text messages only to a number whose owner has agreed to receive them. Reply STOP to any text to opt out, or email support@neoninnovation.com to opt out of any marketing channel: phone, text, or email.

We do not use your personal information to make decisions with a legal or similarly significant effect on you through a solely automated process with no human involvement.

5. How We Share Information

We share information with service providers that help us run the Services (hosting, e-commerce and payment processing, customer relationship management, forms and scheduling, and communications and support), limited to what each needs to do its job for us.

Apple, Google, and our payment processor handle information under their own privacy notices, not solely on our behalf. Apple and Google independently control billing, subscriptions, and certain app diagnostics for the Neon Swim app; our payment processor independently handles your card information to process your purchase and prevent fraud. This Policy does not govern their handling of your information.

Our online store runs on Shopify, which likewise handles some information on its own behalf and not only on ours. Shopify hosts the store and processes information about your visit and your order so that the store works. For certain features Shopify provides to merchants, Shopify decides how the information is used rather than acting only on Neon's instructions, under Shopify's own privacy policy rather than this one, and Shopify operates its own privacy portal that answers requests about those uses. Section 10 tells you how to reach it. If Neon moves the store to a different platform, we will update this Policy.

Neon does not sell personal information for money and does not intend to. Shopify does use customer data from our store, together with data Shopify holds of its own, for ad targeting and personalization for our store, and Shopify states that no other merchant can see our customer data. Neon does not receive the data Shopify holds of its own, and Neon does not control what Shopify does with it. Some state privacy laws treat that use as a "sale," as "sharing," or as processing for targeted advertising, even though no money changes hands. Section 9 tells you how to opt out of it.

We may disclose information if required by law, to comply with valid legal process, to investigate suspected fraud, to respond to a payment dispute, or to protect the rights, property, or safety of Neon, our customers, or others.

Neon is based in the United States and sells and ships to customers in the United States. Not all of our providers are United States companies, and some processing may occur outside the United States as part of a provider's own operations.

If Neon is acquired, merges with another company, or sells or transfers all or part of its business, a product line, or the assets associated with one, personal information relating to that business or those assets may transfer to the acquiring, surviving, or receiving entity as part of that transaction, including during diligence or negotiations for such a transaction. Neon will seek to have the recipient continue to handle that information under this Policy or give you notice of a different one.

6. Data Retention

We keep personal information as long as we reasonably need it for the purposes described in this Policy: completing your order or service request, support and warranty service, accounting and tax records, resolving disputes, preventing fraud, and legal obligations. When we no longer have a reason to keep it, we take reasonable steps to delete or de-identify it. We keep contact information for marketing until you unsubscribe or we no longer have a reason to keep it.

7. Security

We use reasonable administrative, technical, and organizational measures to protect personal information against unauthorized access, loss, misuse, or alteration. No method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Children's Information

Neon's customers and purchasers are adults and organizations, such as swim teams, schools, clubs, and aquatic centers, though swimmers, including minors, use the Neon Swim app and are present where our products are used, such as on a pool deck. The app does not require an account and does not ask a swimmer for personal information.

Neon does not knowingly collect personal information directly from a child under the age of 13. If you are a parent or guardian and believe a child under 13 has given us personal information directly, contact support@neoninnovation.com and tell us what is involved. We will review what you report and, where appropriate, delete or restrict it, except where we need to keep it for a legal, safety, or recordkeeping reason we are permitted to rely on.

Neon does not have actual knowledge that it sells or shares the personal information of anyone under 16 years of age.

9. Your Privacy Choices and Rights

See Section 4 for how to stop receiving marketing email.

If you do not want information about your activity in our online store used for ad targeting and personalization, email support@neoninnovation.com and ask us to opt you out. That route is open to everyone, wherever you live, and we honor it. Our online store also publishes a data sharing opt out page, linked from the store, which is available to residents of the states whose laws require it. An opt out made on that page is recorded for the browser and device you use it on, so make the choice again on each browser and device you use. Email reaches us either way.

Depending on where you live, you may have the right to access, correct, or delete personal information we hold about you. Section 10 explains how to ask, and we honor requests as applicable law requires.

10. Your Requests

You can ask us about the personal information we hold about you, or ask us to access, correct, or delete it, by emailing support@neoninnovation.com. Tell us who you are and what you are asking about so we can find the right records; we may ask you to verify the request is yours. We will look at the systems we control that are reasonably likely to hold your information and respond as required by the law that applies. If we find nothing, we will tell you that.

If someone makes a request on your behalf, we may require written proof that you authorized them, and we may confirm the request with you directly before we act on it. We may decline a request we cannot verify, and we will say so if we do.

Some information related to the Neon Swim app, such as your purchase or subscription history, is controlled by Apple or Google rather than by Neon; direct requests about it to the applicable app store's privacy or account settings.

Information that Shopify holds for its own purposes, described in Section 5, is not in a system Neon controls. Direct requests about that information to Shopify, using the privacy portal and contact route Shopify publishes with its own privacy policy. If you are not sure which of us holds what you are asking about, email support@neoninnovation.com and we will tell you what we can.

If you are not satisfied with how we handled your request, you may also be able to raise it with the consumer protection or data protection authority where you live.

11. Changes to This Policy

Neon may update this Policy to reflect changes in our practices, services, or legal requirements. When we do, we will post the updated policy here, update the effective date, and increase the version number above. The updated policy applies to information we handle from the effective date forward. The version posted here always governs. The effective date and version number above show only when this Policy was last changed; they do not mean you separately agreed to that version, and this Policy does not require your separate agreement to take effect.

12. Contact Us

Questions about this Policy, or about how Neon handles your personal information, should be sent in writing to support@neoninnovation.com. Please use email rather than the phone for these, so that both you and Neon have a record of what was asked and what was answered. Email is the channel Neon watches for privacy questions and requests.

The address above identifies Neon and is where formal written notices may be sent. It is not a return address for a product. If you are returning a product or shipping a trade-in device, use the shipping address Neon gives you for that shipment, and see our Warranty and Return Policy and our Trade-In Program Terms and Conditions.
